Amendments to Bulk Entitlements held by Greater Western Water

The Minister for Water has received an application under the Water Act 1989 from Greater Western Water to consolidate its Bulk Entitlement (Greater Yarra System – Thomson River Pool – Western Water) Order 2014 into its Bulk Entitlement (Greater Yarra System – Thomson River Pool – City West Water) order and change relevant references from Western Water and City West Water to Greater Western Water.

The proposed amendments will simplify the management and accounting for these bulk entitlements.

Application overview

The amendments are required to reflect the integration of Western Water and City West Water and subsequent name change to Greater Western Water. As Western Water and City West Water both held bulk entitlements in the Greater Yarra System – Thomson River Pool, this means Greater Western Water holds two bulk entitlements in this system. The amendment will consolidate these two bulk entitlements into one, simplifying the management and accounting arrangements.

Why are these changes needed?

On 1 July 2021, the Minister for Water via a section 87(1) of the Water Act 1989, integrated Western Water and City West Water into one water corporation. The name of this water corporation was then formally changed Greater Western Water on 1 July 2022 via the Water and Catchment Legislation Amendment Act 2021.

Although all bulk entitlements previously held by Western Water and City West Water are automatically legally held by Greater Western Water, consequential changes are needed to update the old references to these water corporations to Greater Western Water for clarity and good governance purposes.

In addition, Greater Western Water now holds two bulk entitlements in the Greater Yarra System-Thomson River Pool, so consolidating these two bulk entitlements into one will simplify the management and accounting arrangements.

What changes are being proposed to entitlements held by Greater Western Water?

The application seeks the required amendments to enable the Bulk Entitlement (Greater Yarra System – Thomson River Pool – Western Water) Order 2014 to be consolidated into its Bulk Entitlement (Greater Yarra System – Thomson River Pool – City West Water) order. It will also enable all references to Western Water and City West Water to be updated to Greater Western Water.

Next steps

The Minister for Water will consider the application from Greater Western Water, taking into account the requirements of the Water Act 1989. Subject to the Minister for Water’s approval, the bulk entitlement amendment will come into effect when it is published in the Victoria Government Gazette.
